REGULAR MEETING MINUTES

August 25, 2008

The Pledge of Allegiance was led by Jeremy Hinman of the Miami Township Fire Department.

MINUTES
The motion to approve and dispense with reading the minutes of previous meeting was made by Mr. Sammons. Mr. Boll seconded the motion. Motion carried 100%.

TREASURER’S REPORT
Ms. Ross pointed out that the investment balance was $336,741.77.  The Village invested a total of $300,000.00 originally.  She explained there are 2 $100,000.00 bonds insured by FDIC and 2 CD’s for the rest of the investments.
Mr. Sammons asked why the expenditures did not match up to the cash summary by fund report.  Mr. Nunnery pointed out to Mr. Sammons that the employees were not paid three times in August as Mr. Sammons questioned because there are v’s after the report, meaning checks were voided.
Motion was made by Mr. Welch to pay the bills.  Mrs. Romweber seconded the motion.  Motion carried 100%.

MAINTENANCE SUPERVISOR’S REPORT
Supervisor Gillespie reported the department has been busy painting crosswalks, curbs and stop at the stops sign throughout the Village. There was also a new parking place painted outside the municipal building for the physically challenged.
The new Christmas decorations were opened and checked out.  Mr. Gillespie spoke with Mr. Paul Bishoff from Duke Energy about getting the electric boxes on the poles for the new lights. He also drove through the Village with Mrs. Rita Allen to discuss where the new lighted decorations would be placed.
He contacted Seal and Stripe and requested a bid for Turnberry which he gave to Mr. Boll.

POLICE REPORT
Officer Hyrnak reported there were 64 police details in the village in July.
There was a large theft valued at $10,000 worth of steel from Consolidated Grain.
There was a theft of an SUV on Harbor Drive and 2 domestic cases at 6 and 22 Miami Avenue.
Officer Hyrnak reported that traffic should settle down once families get acclimated to the new school schedules.
Mayor Simpson had called the Department about a car at Harrison Tomb.
 There was discussion about cars (usually unlocked) had been broken in to in Aston Oaks.  Citizens were reminded to lock their cars.

FIRE REPORT
Deputy Chief Ober was not at the meeting. Lt. Jeremy Hinson gave the fire report.
He reported there were 13 EMS runs and 1 fire response in July.

Mr. Jim Holt was recognized for taping the August 25th meeting.


THREE RIVERS SCHOOL DISTRICT
Three Rivers residents were reminded that school had started.  Also the school district is collecting aluminum cans to benefit the District.

COMMITTEES
Finance
Mr. Welch reported that Mr. Art Beinkemper had agreed to serve on the Village Audit Committee.
Serving on the Audit recommended committee with Mr. Beinkemper will be the Mayor, Chairman of the Finance Committee and the Clerk/Treasurer Sheryl Ross.  Solicitor Reichert will write the resolution.

Law & Ordinance
Mrs. Romweber encouraged Council to adopt the updated Ordinance pertaining to Public Solicitation.  Mayor Simpson said the Village Council cannot keep people from soliciting but we can control the solicitation with this updated Ordinance.
Mr. Welch made motion to adopt Ordinance 2008-07 as an updated version concerning Village Solicitation. Mr. Hartoin seconded the motion.  Motion carried 100%.

Light, Water and Sewer
Mr. Nunnery reported that the Aston Oaks lighting assessment is not due in the Auditor’s Office until mid November.  This will give Mr. Nunnery the time to add any new Village properties to the January 2009 assessment.
Mayor Simpson reported that there will be a sewer repair at Taylor and Symmes this coming Friday, August 29, 2008.

Maintenance
Mr. Boll reported that the Maintenance meeting was attended by Mayor Simpson, Clerk/Treasurer Sheryl Ross, Mr. Gillespie and Mr. Boll.
Procedures for buying equipment and establishing an emergency vendors list were discussed.
Procedure to handle road repairs was also discussed.
Mr. Boll opened the only bid from Seal and Stripe for the repairs at Turnberry.  Mr. Hartoin reported that Mr. Niehaus said the damage was not done by the new homeowner (Fehring) but Rumpke.  Mr. Boll will send a letter asking the Fehrings to substantiate that their subcontractor did not do the damage.
Mr. Boll moved that the Village have the Turnberry road damage repaired by Seal N’ Stripe for $800.  We will then bill the responsible party for the repair.  Mr. Welch seconded the motion.  Motion to repair Turnberry carried, with the Village billing the determined responsible party, 100%.

Planning and Zoning
No Report

Police & Fire
Mr. Hartoin again requested that residents keep their eyes open for criminal activity and again encouraged citizens and visitors to lock their cars.

COUNCIL OLD BUSINESS
Mayor Simpson reported that Dollar General has removed the dead trees.
Mayor Simpson thanked Mr. Holt who has agreed to tape 2 meetings. We have received one application to tape the meetings.

SOLICITOR OLD BUSINESS
Solicitor Reichert asked Council about how they wished to proceed with setting up a road bond for the builders of new homes.  Mr. Hartoin asked Mr. Niehaus how he did the bond when he was responsible for the Aston Oaks roads.  He said $2000 or $3000 of the bond was set up for the road.  The remaining $3000 would go toward the new homeowners landscaping.  The bond was returned when there was no road damage and the landscaping was completed.  This ordinance will be adopted next month and it will be tied into the building permit.
Mayor Simpson will call Cleves Waterworks concerning a letter received today concerning the waterline.

MAYOR’S OLD BUSINESS
Mayor Simpson is looking into the Eagles Cliff Overlook railing.  The overlook may be on private property. The Hamilton County Building Department will determine if Mr. Niehaus needs to place a railing as requested by Zoning and Planning.

SOLICITOR NEW BUSINESS
Mr. Reichert read the first reading of Ordinance 2008-08 – that requires new builders of Village homes to post a bond to guarantee repair of Village streets if they are damaged by the construction.

COUNCIL NEW BUSINESS
Mrs. Romweber suggested it would be nice to have a Fall Festival and possibly generate funds to beautify the Village.
There was a complaint concerning the noise generated from Consolidated Grain.  The previous Sunday morning was especially unbearable.
Mayor Simpson will talk to the new Manager, Mr. Scott Perkins.  Mayor Simpson will invite Mr. Perkins to our September meeting.

MAYOR’S NEW BUSINESS/REPORT
Mrs. Romweber moved that the Wayne property area be mowed as they were notified over 10 days ago.  If the Village mows, Mr. Wayne will be assessed for the charges on his property taxes.  Mr. Boll seconded the motion. Motion carried 100%.  Motion carried as Resolution 2008-16.
Mayor Simpson shared the village Public Health report with Council.
He reported signs will be placed in the park to ask residents to clean up after their dog.
Mayor Simpson also notified Council that the house at 9 Washington Avenue will be rehabbed from the spring fire. The owners do not know if they will sell or rent.
Mayor Simpson reported that the property around the village barn will be surveyed.
He suggested that the village spend $100 annually to belong to the Ohio Co-operative Purchasing Association.
He also would like to do a quarterly Village Newsletter and will investigate funding with recycling monies.  He will explore the opportunity with Rumpke.

OPEN TO THE FLOOR
Ms. Jamie Buzek from 162 Miami Avenue spoke about the Village complaint concerning their tall grass.  She said they were mowing their yard as she was speaking.
Ms. Buzek reported that the reason it hadn’t been mowed was because they were frustrated with the occupants at 11 W. Harrison dumping garbage in their yard and putting their garbage out days before actual pick up.
Mr. Simpson will contact the family at 11 W. Harrison to correct the problem.

Romwber seconded the motion.   Motion carried 100%. The meeting was adjourned at 8:46 P.M.
