Meeting was called to order at 7:00 P.M. by Mayor Sammons.

MAYOR’S OPENING STATEMENT
Mayor Sammons reviewed our " Breakfast with Santa" event which was held this past Saturday. Approximately 25 children attended and he talked about some of the kid’s stories. The Mayor said everyone is welcome to contribute and all donations will only go to North Bend families. Please see Marilyn in the Village office.

Ron Nunnery moved that the November 18th Minutes be accepted. Bill Welch seconded the motion. Motion carried 100%.

POLICE REPORT
Sgt. Steers reported forty-one (41) calls for November. He talked about an incident at Taylor High School involving copper theft. Sgt. Steers reviewed several other incidents and their status.
There will be a Conceal and Carry Permit course through the Hamilton County Sheriff’s office. It will cost $95.00 (plus a $40.00 rental, if gun needed). There will be two courses: January 7, 9 and 11 (times for January 7 and 9 are from 5-9pm and January 11 from 8-12noon). The second course will be February 8 and 9. (times for Feb. 8 is 8-5pm and Feb. 9 is 8-4pm). This will take place at the Sheriff’s Office, 8100 E. Miami River Road at the firing range. The class size is limited. Please call 825-1500 and ask for Captain Earl Price to register.
Mayor Sammons thanked Sgt. Steers for his updates throughout the month. He said it helps him to be kept abreast of local happenings.
 

GUESTS
Brian Schmidt of Choice One Engineering passed out an information sheet on his company’s service and gave a short talk on the services they offer. They currently service the Loveland and Lebanon entities.
Mr. Nathan Redding, resident at 44 Taylor Avenue thanked Council and Rick Schultz for their prompt response to his street problem.

THREE RIVERS SCHOOL DISTRICT
No one attended. Mayor Sammons read from the Three Rivers website and highlighted several upcoming events. Please see the Three Rivers website for details.

Mr. Welch reviewed the minutes of the Finance Committee meeting.
Bill Welch made motion to accept Ordinance 2013-04 for the Annual Appropriation Ordinance for Fiscal Year 2014. Ron Nunnery seconded the motion. Motion passed 100%.

There will be a Neighborhood Watch meeting on Thursday, January 23rd at 7:00p.m. in Council Hall.
 

Planning & Zoning - Mrs. Romweber
There will be a Planning Commission meeting on Monday, December 23rd at 5:00p.m. in Council Hall to discuss the proposal regarding the athletic facility at North Bend Center on the west side of St. Annes, which is somewhat behind the Dollar General. It will be approximately an 8,100 sq. ft. building. No zoning change is required.
 

Law & Ordinance - Mr. Moorman
Regarding the Residential Rental Permits, there are still four (4) in non-compliance. Mr. Weber, our code enforcer, is going to personally verify that these four units are actually rented. Non-compliance fines are on hold until he can confirm.
The Mayor stated that the residence at 464 Three Rivers Parkway is deteriorating fast. Dick Weber will follow-up.
 

Beautification – Fran Romweber
Our next Beautification Committee meeting will be held Saturday, January 11, 2014 at 10:00am in Council Hall.
Mrs. Romweber reviewed our Three-Year Budget Plan (See Attached) and commented that this plan is not set in stone and can be changed as needed.
Mayor Sammons thanked Fran for her efforts in chairing this committee. Guest, Marilyn Kramer, Deputy Clerk of North Bend noted that she has received compliments from residents and one of our bank tellers about the improvements made regarding the beauty of North Bend. Other Council members echoed that comment.
Mayor Sammons reviewed the We Thrive Committee meeting that our Deputy Clerk, Marilyn Kramer attended and stated that the City of Montgomery has offered to donate a substantial piece of premium playground equipment to North Bend. More information will follow.

Mayor Sammons reviewed the OPERS rules and the effect it has on Council credits for service. Bill Welch made motion to accept Ordinance 2013-09 Setting Pay Rate for Village Council Members and Mayor. Dave Moorman seconded the motion. Motion passed 5-1. Ron Nunnery voted no.

MAYOR’S FINAL COMMENTS
Mayor Sammons recognized the service of Tim Boll who has been a Council member since 2006. The Mayor gave him a Proclamation, a plaque and a small gift certificate.
Mr. Boll stated that serving as a Council member for North Bend was an honor.

TREASURER’S REPORT
December 16, 2013
To Council Members for Your Information and Review

The Finance committee met earlier this month to work on the proposed 2014 Appropriations budget. Mr. Welch will be reviewing the results of that meeting later tonight.

We received certification of our Fire/Ems levy passage from the County Auditor’s office. I have placed a copy in your packet. We also received certification of our gas aggregation issue passage.

We received our quarterly franchise check from Cincinnati Bell in the amount of $646. This amount has been steadily increasing.

We wrote five Purchase orders this month:

1) $7000 to JMA for engineering for the Shady Lane rehabilitation project
2) $10,000 to Miami Township for 2013 fire protection
3) $920.10 for garage shelving
4) 915.71 for street and traffic signs
5) $790 for the wall display in Council Hall


Distributed to council members this month are the following reports:

Showing money in/money out and the check book balance
• Payment and charge Register Report:
Includes all checks & automatic payments taken directly from our checkbook since last Council Meeting

has a temporary 4" riser, will complete when weather allows

- Cleaned out storm water culvert on north side of Three River Parkway,
east of St. Anne’s

- New street signs and STOP sign at Cliff and Brower

- Installed reconditioned sign at corporation line on Shady Lane

- New STOP signs at: Southbound Miami @ Harrison

- To date, we have replaced nine (9) STOP signs with nine (9) remaining in
the old part of the Village. Mr. Hartoin is attempting to set up a meeting
with Mr. Niehaus to map out plans to update signage in Aston Oaks.

ANNUAL APPROPRIATION ORDINANCE FOR
FISCAL YEAR 2014

WHEREAS, Ohio Revised Code Section 5705-38 mandates that the Village shall pass an Annual Appropriation Ordinance, and

WHEREAS, the Council of the Village of North Bend, Ohio, has determined that the attached Appropriations which are incorporated herein, and made a part hereof, are necessary for the continued operation of the government of the Village;
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of North Bend, Ohio _____ members elected thereto concurring; that the attached Annual Appropriations for current village expenses and expenditures during the fiscal year ending December 31, 2014, be and hereby are approved and adopted.

This Ordinance is hereby declared to be an emergency measure necessary to preserve the health, safety and general welfare of the Village and that by reason thereof it shall become effective immediately.

FOR THE PERIOD JANUARY 1, 2014 TO DECEMBER 31, 2014

WHEREAS, The Council of the Village of North Bend, Ohio, has determined that the position of Engineer for the Village is necessary;
WHEREAS, the Council has determined that JMA Consultants, Inc., and Daniel Schoster, an Engineer licensed in the State of Ohio, can fulfill those duties.

NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of North Bend, Hamilton County, Ohio _____ members elected thereto concurring that:

Section 1: That the position of Engineer for the Village of North Bend is hereby re-established.

Section 2: That JMA Consultants, Inc. and Daniel Schoster are hereby appointed to said position. That JMA Consultants, Inc. and Daniel Schoster shall perform all those duties and functions required as Village Engineer.

Section 3: That compensation for the Village Engineer shall be an hourly basis as attached.

This Ordinance is hereby declared to be an emergency measure necessary to preserve the health, safety and general welfare of the Village and that by reason thereof it shall become effective immediately.

ORDINANCE RE-APPOINTING HAMILTON COUNTY BUILDING
COMMISSIONER TO PROVIDE INSPECTION AND OTHER SERVICES
NEEDED BY THE VILLAGE

WHEREAS, The Council of the Village of North Bend, Ohio, has determined that it is necessary to retain engineers to provide engineering and inspection services to insure that building and development comply with North Bend, Hamilton County, and State regulations;
WHEREAS, the Council of the Village of North Bend, Ohio, finds that the Hamilton County Building Commissioner has the expertise necessary to provide said services.

NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of North Bend, Ohio _____ members elected thereto concurring that:

Section 1: The Village Council authorizes the Mayor to retain the Hamilton County Building Commissioner pursuant to contract, which is included herein by reference, for the period from 1/1/2014 to 12/31/2014 for the purpose of approving plans, drawings, specifications and data; issuing permits and making inspections for any and all building and other structures erected within the Village, as provided in said Building Codes.

Section 2: It is further provided that the fee schedule adopted by the County for such review, inspection and approval services shall apply to the Village. Fees paid by the Village of North Bend regarding the Aston Oaks development are to be recovered from the developer of the Aston Oaks Project pursuant to ordinance passed in December of 1992.

Ordinance appointing the Village Law Director
for the period January 1, 2014 through December 31, 2014

WHEREAS, the Council of the Village of North Bend, Hamilton County, Ohio has determined that the position of Law Director is necessary to effectively handle legal matters on behalf of the Village; and

WHEREAS, the Council has determined that James A. Reichert, an Attorney licensed to practice law in the State of Ohio, can fulfill said duties;
NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of North Bend, Hamilton County, Ohio _____ members elected thereto concurring:

Section 1: That the position of Village Law Director is hereby established; and

Section 2: That James A. Reichert is hereby appointed to fill the position of Law Director and that he shall perform all the duties and functions required of him by law as Law Director, and shall (a) attend at least one Council meeting per month and (b) render legal advice and perform all drafting necessary to prepare all Ordinances and Resolutions of the Village Council and (c) act as legal advisor to the Mayor and Village Council in all matters where legal advice and counsel may be required.

Section 3: That the compensation for such legal services as Village Law Director shall be billed monthly at the rate of One Hundred Seventy-five ($175.00) Dollars per hour.

Section 4: This Ordinance is hereby declared to be an emergency measure necessary to preserve the health, safety and general welfare of the Village and that by reason thereof it shall become effective immediately.

Section 1: That the position of Public Works Administrator for the Village of North Bend is hereby re-established.

ORDINANCE SETTING PAY RATE FOR VILLAGE
COUNCIL MEMBERS AND MAYOR

WHEREAS, the Council of the Village of North Bend, Ohio, has determined that it is necessary to revise the pay rate for the position of Mayor and Village Council members beginning January 1 in the year in which the Mayor’s or Council members term next commences; and

WHEREAS, the Council has determined that the positions of Mayor and Council members shall be salaried and paid monthly as follows:

Council members - $3,600.00 per year payable monthly at $300.00 per month
Mayor - $7,200.00 per year payable monthly at $600.00 per month

NOW, THEREFORE, BE IT ORDAINED by the Council of the Village of North Bend, Ohio, _____ members elected thereto concurring that:

Effective January 1, 2016, the Village Mayor shall receive yearly compensation of $7,200.00 payable monthly at $600.00 per month;
Effective January 1 of the year their next term begins each Council members’ position shall receive yearly compensation of $3,600.00 payable at $300.00 per month.

This Ordinance is being enacted in deference to certain changing provisions of the Ohio Public Employees Retirement System and is therefore declared to be an emergency measure effective immediately in order to preserve and protect the safety and welfare of the residents of the Village by encouraging continuing committment to public service by its Mayor and Council members.

WHEREAS, it is the desire of the Village of North Bend to enter into a contract with the Hamilton County Regional Planning Commission for zoning and compliance services; and

WHEREAS, the Hamilton County Regional Planning Commission is agreeable to the furnishing of said services upon the terms and conditions as set out in the contract hereto attached and marked Exhibit A; and

WHEREAS, it is the opinion of Council that said contract is for the benefit, safety and welfare of the Village of North Bend and its residents and property owners;
NOW, THEREFORE, BE IT RESOLVED by vote of the Council of the Village of North Bend, _____ members elected thereto concurring:

Section 1: That the Mayor of the Village of North Bend is hereby authorized to enter into the contract with the Hamilton County Regional Planning Commission , attached as Exhibit "A", effective 1/1/14 through 12/31/14.

RESOLUTION APPOINTING VILLAGE STREET COMMISSIONER

WHEREAS, Section 735.31 Ohio Revised Code requires the Mayor of the Village to appoint a Village Street Commissioner with the approval of Council; and

WHEREAS, the Council for the Village has determined that it is necessary to appoint a Council member to perform the duties of Street commissioner; and

WHEREAS, Council Member _______________ has indicated to Council that he is willing to perform the duties of the Village Street Commissioner;
NOW, THEREFORE, BE IT RESOLVED by the Council of the Village of North Bend, Hamilton County, Ohio _____ members elected thereto concurring that:

_______________ be and hereby is appointed Street Commissioner for the Village of North Bend, Ohio, for a period of one year, beginning January 1, 2014; and that:

_______________ shall perform all of the duties of the Village Street Commissioner including the inspection and supervision of maintenance, repair, replacement, construction and reconstruction of all streets and sidewalks in the Village.

That _______________ shall have as part of his duties the authority to issue maintenance and repair orders, as well as to issue citations to any person, firm, or business that fails to properly maintain or repair any sidewalk or street as required by Title 4 of the North Bend Revised Code of Ordinances.
