Members Present: Mayor Mr. Rolfes Clerk Ms. Ross Councilpersons Mr. Nunnery, Ms. Romweber, Mr. Simpson, Mr. Albu Mr. Seifert and Mr. Montague Maintenance Mr. Gillespie Supervisor Absent Solicitor Mrs. Rentz Mr. Rolfes opened the meeting with the Pledge of Allegiance. MINUTES: Mr. Seifert moved that the May minutes be approved as written. Mrs. Romweber seconded the motion. Motion carried 100%. TREASURER’S REPORT: The Treasurer’s Report was reviewed. Mr. Albu moved to accept the May 2004, Treasurer’s Report. Mr. Seifert seconded the motion. Motion carried 100%. Mr. Albu moved that we pay Village bills. Mr. Seifert seconded the motion. Motion carried 100%. POLICE REPORT: Officer Greer reported that $7700 of property had been stolen in May and that there is an investigation in place. There was a fight, felonious assault and a hit-skip regarding a red vehicle. Mr. Simpson encouraged our citizens to call 825-2280 if they notice noise or problems in the Village. Citizens can request to be anonymous when the report is made. Mr. Albu said he was aware of an accident at Shady Lane. Officer Greer was unaware of this accident. FIRE REPORT: Assistant Chief Ober reported that in May there were 70 EMS details of which 7 were in the village. There were 30 fire details and none were in the Village. On June 1st there was an accident at Shady Lane and US50. He reported the Department is offering two classes this summer: Baby sitting Citizens interested in serving on an emergency response team. Assistant Chief Ober said to contact the firehouse for information. GUESTS: None COUNCIL OLD BUSINESS: Mr. Rybolt requested that the Village issue him a license to fill in the lower end of Lower River Road so he can access his property. Mayor Rolfes expressed concern that the Village has no jurisdiction below 34.1 feet and if fill is below that level then problems could come back on the Village. Mr. Rybolt says he has received approval from: US Fish and Wildlife Ohio Department of Natural Resources Ohio Historical Society Eastern Shawnee Tribe EPA Army Corps of Engineers approval is pending Mr. Albu said he would abstain from any vote on this issue and if he speaks it will be as a citizen not as a council member. Mrs. Albu discussed the history of this property and the concern that Mr. Rybolt’s trucks that will build the fill could undo prior work. She is also concerned about the Village liability should Mr. Rybolt not maintain the property as well as the possibility of Mr. Rybolt to block the Village road. Mr. Kane expressed his concern if license is granted and requested licenses be granted to him for his 5 parcels also. Mathew A. Montgomery, attorney for Mr. Albu, requested that this license not be granted to Mr. Rybolt. Mr. Montague made the motion that Council accept the license requested by Mr. Rybolt to fill up to 34.1 feet. He must agree not to have a house there. Mr. Montague added that JMA approved Mr. Rybolt’s request that it complies with the Flood Plain Ordinance. Stipulations would be to repair the road if damaged in construction. Containment of fill as addressed by Army Corps of Engineers. The motion was tabled because of the Village solicitor was not present. Mr. Montague made motion to table. Mr. Seifert seconded the motion. Motion carried 100%. It was suggested that the Law and Ordinance Committee meet with the solicitor and JMA to study Mr. Rybolt’s request. A tentative date was scheduled for July 19, 2004, at 6:00P.M., pending solicitor attendance. SOLICITOR OLD BUSINESS: None MAYOR’S OLD BUSINESS: COMMITTEES: Mr. Albu explained that our 1Mil levy for Life Squad emergency services ends beginning 2005. He said a resolution needs to be passed to certify the dollar amount for the Auditor. Mr. Albu moved that we request the Auditor certify the dollar amount to replace our 1 Mil Life Squad emergency services levy. Mr. Seifert seconded the motion. Motion carried 100%. Mr. Albu said we would officially pass that the levy be added to the November 2004 ballot for the voters to decide at the July Council meeting. Mr. Albu scheduled a Budget meeting for 7:00 PM on Wednesday July 14, 2004. Mr. Seifert scheduled a maintenance meeting for 6:00 PM on Wednesday, July 14, 2004 to put together 2005 budget requests. Police & Fire Mr. Simpson reported that his Safety Committee met concerning the traffic light on Shady Lane and US50. State Representative Steve Driehaus, State Representative Bill Seitz and Miami Township Trustee Jack Rininger also attended. ODOT will hold a public hearing while the traffic study is completed. The Deputy Director of ODOT will hold a meeting on July 7, 2004, at 1:00 PM in Lebanon. The Mayor, Mr. Simpson and Mr. Albu will attend. Mrs. Romweber and Mr. Simpson will meet to go over Village ordinances in order to provided Officer Greer with the specific ordinances for his knowledge in issuing citations. Maintenance Maintenance Supervisor Leo Gillespie reported on Village work in May. He brought up the option to purchase a used walk behind mower that would cut grass cutting time in half. Discussion on purchasing the mower will take place at the July maintenance meeting. COUNCIL NEW BUSINESS: It was reported that the Ohio Historical Society is in the process of putting out bids to renovate William Henry Harrison’s Tomb. They will come to Council to let the Village know what is happening regarding the renovation. SOLICITOR’S NEW BUSINESS: None MAYOR’S NEW BUSINESS: Mayor Rolfes said that Commissioner Phil Heimlich would attend our July Council meeting to get input on what we expect from the County. Taylor High School has requested the Village help them obtain signs because there will be no busing next fall. Because this could be a serious issue, Mayor Rolfes referred it to the Maintenance Committee meeting July 14, 2004, at 6:00 PM. Mayor Rolfes received information from the Ohio Consumer’s Council regarding ways to lower cost on utilities. He would like to ask Addyston, Cleves and Miami Township to join us to investigate this issue. He will call others to see if their area is interested. OPEN TO THE FLOOR Citizen Mr. Ken Gross reported vandalism to his pool from debris and bricks being thrown in from Village debris next to Administration Building. He will also call regarding the loud music from the parking area. Mr. Montague moved the debris be removed and that “NO PARKING EXCEPT FOR OFFICIAL BUSINESS” be placed in the parking area. Mr. Seifert seconded the motion. Motion carried 100%. Mrs. Margaret Knapp requested a procedure to report zoning and ordinance violations. This request was referred to the Zoning and Planning Committee. ADJOURNMENT Mr. Albu moved that the meeting be adjourned. Mr. Nunnery seconded the motion. Motion carried 100%.
