21 TAYLOR AVENUE, NORTH BEND, OHIO 45052 REGULAR MEETING MINUTES June 30, 2008 Members Present: Mayor Mr. Simpson Councilpersons Mr. Hartoin, Mr. Nunnery, Mr. Sammons, Mrs. Romweber, Mr. Boll, Mr. Welch Solicitor Mr. Reichert Fiscal Officer Ms. Ross ZONING AMENDMENT The motion to vote on the zoning amendment for 36 Taylor Avenue as Ordinance 2008-06 was made by Mr. Sammons. Mr. Hartoin seconded the motion. Motion carried 4-2 with Mr. Welch and Mr. Boll voting No. Mayor Simpson opened the regular meeting at approximately 7:45 P.M. June 30, 2008, with the Pledge of Allegiance. Clerk/Treasurer called the roll. All Council members were present. The Mayor, Solicitor and Clerk/Treasurer were present. MINUTES The motion to approve and dispense with reading the minutes of previous meeting was made by Mr. Nunnery. Mr. Boll seconded the motion. Motion carried 100%. TREASURER’S REPORT Ms. Ross reported that she has requested an extension from the Hamilton County Auditor’s Office for the 2009 Tax Budget because Council just met with JMA to finalize the grants to be applied for in 2009. The Tax Budget will be voted on at the July meeting following the advertising of the Budget 10 days prior to the vote. The motion to pay bills was made by Mr. Welch. Motion was seconded by Mrs. Romweber. Motion carried 100%. MAINTENANCE SUPERVISOR’S REPORT Mr. Gillespie reported he had met with John and Keith Niehaus regarding the water at Aston Oaks Drive and Shady Lane. Neither John nor Keith had a suggestion as to where the water could be coming from. The department will monitor this problem until a cause is discovered. Mr. Gillespie requested two bids for the St. Annes repair. West Side Paving and Stripe and Seal were contacted for the bids. Mr. Gillespie contacted the Mayor after receiving complaints regarding the tires stored on the property at Hahn’s Auto. After all the heavy rain Supervisor Gillespie checked the storm drains on Washington Avenue and everything was in working order. Mr. Gillespie was called by the Communications Center on June 25 at 5:00 P.M. to report that the traffic light was not operational. After informing Mr. Boll, Mr. Boll contacted Wagner Smith Capital Electric and they completed the repair within 3 hours. The department put out the flags for Flag Day. The department put up two new shelves in Ms. Ross’ office. They have also been busy cutting and trimming grass throughout the village. POLICE REPORT Officer Hyrnak reported that there were 64 details in the Village for May and of those 8 reports were in the Village, a rather high number. Reports were: a suicide, a drug possession, a domestic violence at 22 Washington, a theft at 22 Washington, an assault at the Post Office, a criminal damaging on Cliff Road and 2 squad runs. Mrs. Rita Allen requested that the officers watch the skateboarding at Taylor High School and Harrison Avenue. Mayor Simpson reported finding two cases of beer and ice at Harrison’s Tomb. It was also reported that people in Aston Oaks are ignoring the stop signs. Officer Hyrnak said he would ask the officers to watch those areas. FIRE REPORT Lt. Paul Montamon reported for Deputy Steve Ober who was on detail during our meeting. Mayor Simpson expressed a thank you to Chief Ober for helping to make certain the electric was restored on Summit Avenue for an elderly lady who has a life alert system. GUESTS None THREE RIVERS SCHOOL DISTRICT No report COMMITTEES Finance Mr. Welch reported that the Clerk/Treasurer Sheryl Ross, Mayor Simpson and himself met with the State Auditor’s representatives on May 21, 2008 to go over the final report for audit years 2006 and 2007. We will establish an audit committee and an investment policy as they suggested. Law & Ordinance Mrs. Romweber reported that her committee met on June 18, 2008 to complete the Council Rules. Light, Water and Sewer No report Maintenance Mr. Boll reported that council members and the Clerk/Treasurer met with JMA on June 25, 2008 to discuss road refurbishment in North Bend. It was decided that Cliff Road would be a priority at a cost share for the Village of $23,500. Brower Road would cost the Village $35,000 and Woodruff would cost the Village $30,000. It was decided to ask JMA to apply for grants for all 3 roads and the redoing of the water lines currently covered by Addyston to be covered in the future by Cleves. The Village share of the waterline cost would be $57,500 but the residents involved could be assessed for the $57,500 cost to cover a reasonable amount for a number of years. Mr. Schoster reported that, if we were selected for all the grants, we could spread the projects over 2009 and 2010. Mr. Boll opened the one bid submitted to repair St. Annes from the damage. Seal and Stripe said the repair cost would be $944. Mr. Boll moved that we accept the bid for the repair by Seal and Stripe and that Mr. Niehaus be billed for the damage. Mr. Welch seconded the motion. Motion carried 100%. Mr. Hartoin informed Mr. Boll that there are two damaged areas on Turnberry that need to be checked out. The damage seems to have occurred with the building of the new house on Turnberry. Mr. Boll will point out that damage to Mr. Niehaus who holds bonds for road damage on the new homes. Planning and Zoning Mr. Sammons reported that there are 2 properties that have property maintenance violations. He has received letters from citizens that they are out of compliance. He feels he would like to visit the properties but would need some official ID to do so. Mayor Simpson reported that Chief Ober is working to get all elected officials in the Village ID badges. Mayor Simpson will remind Chief Ober that we need to have these completed as soon as possible so Mr. Sammons can meet with the non-compliant property owners. Police & Fire There was no report as Mr. Hartoin had reported on the Fire Station tour earlier. COUNCIL OLD BUSINESS No Report SOLICITOR OLD BUSINESS The Law Director read the third reading of Ordinance No. 2008-05 Prohibiting use of Village Personnel or Property. Motion to accept made my Mr. Sammons. Mr. Welch seconded the motion. Motion carried 100%. MAYOR’S OLD BUSINESS Mayor Simpson said the mudslide n US50 had finally been cleaned up by ODOT. The geo-tech personnel from ODOT informed Mayor Simpson that it was felt the hill was stable. Mayor Simpson will send pictures and request information on seeding responsibility. SOLICITOR NEW BUSINESS No report COUNCIL NEW BUSINESS Mr. Welch suggested that council follow through on designating parking for the business that was approved earlier in the meeting at 26 Taylor Avenue. It was decided that the problem be addressed once the purchase of the building is completed in 3 months and as a problem surfaces. SOLICITOR NEW BUSINESS No report MAYOR’S NEW BUSINESS/REPORT Mayor Simpson is working with the manager of Dollar General to replace dead trees on the property. The Lanxess PAG (Public Advisory Group) plant has asked the Village to host a meeting July 28, 2008 at 7:00 P.M. We will host the meeting. There will be no cost to the Village. Mayor Simpson will call Duke Energy to determine what their revised policy will be in relation to their current “clear cut policy”. Resident Mrs. Rita Allen and her son are working with Duke Energy to make certain our area does not have continuing problems. OPEN TO THE FLOOR There was no business from the floor. MAYOR & COUNCIL ANNOUNCEMENTS, COMMENTS Former Mayor Shirley Smith reported that the repair of the curb on Washington Avenue has not held. Mr. Boll will follow up. Ms. Smith also said that at 13 Washington, the storm drain is recessed and should be checked for problems. Mayor Simpson reported there will be two Miami Township sponsored concerts in August next to the Township Firehouse on Shady Lane. They will be August 19 and August 26th, 2008. On August 3, 2008 the North Bend Methodist Church will have a concert at 7:00 P.M. for the benefit of teachers in Haiti. ADJOURNMENT Mr. Hartoin made motion to adjourn the meeting. Motion was seconded by Mr. Sammons. Motion carried 100%. With no further business the meeting was adjourned at 8:50 P.M.
