REGULAR MEETING MINUTES

May 19, 2008

Mayor Simpson opened the regular meeting at 7:00 P.M. May19, 2008 with the Pledge of Allegiance.  Clerk/Treasurer called the roll.  All Council members except for Mr. Sammons and Mr. Welch were present. The Mayor, Solicitor and Clerk/Treasurer were present.   

MINUTES
Mr. Nunnery moved that the April Minutes be accepted. Mrs. Romweber seconded the motion.  Motion carried 100%.

TREASURER’S REPORT
Mr. Hartoin moved that the Clerk Treasurer pay the May bills.  Mrs. Romweber seconded the motion.  Motion passed 100%.

MAINTENANCE SUPERVISOR’S REPORT
Supervisor Gillespie reported the department has
He notified the Mayor regarding the dump trucks and earth movement on St. Annes.
He met with Tri State Liquid Waste about Washington Avenue and was present when the company did the job on Washington and on Woodruff.
The department removed brush that had been dropped off on Summit Avenue. 

POLICE REPORT
Officer Hyrnak was absent.

FIRE REPORT
Deputy Chief Steve Ober was excused. Mr.Hartoin reported that on May 24, 2008 Council is invited to view the 3 stations beginning at 8:00 A.M.  He reported for Chief Ober that there were 3 details in Village for April consisting of a tree that was down, a water leak in a building and a golf cart accident.

THREE RIVERS SCHOOL DISTRICT
Mayor Simpson acknowledged 2 students from Taylor High School who had attended a competition in Reno, Nevada.  They are, Keegan McCarthy and Catie Meyer. 
Catie Meyer reported on the Taylor High School Business class competition in Reno, Nevada.
 Keegan McCarthy also reported. Catie placed in the top 10% in the nation.  Out of the 7 students who attended, 5 received Torch awards.
Sara Cunningham and Mallory Koons representing Taylor High School graduating seniors received from Mayor Simpson a proclamation establishing “Seniors Day in the Village of North Bend”. Ryan Looney, who was in attendance taping the meeting, is also a senior and was recognized.

COUNCIL OLD BUSINESS

SOLICITOR OLD BUSINESS
The second reading of Ordinance No.2008-05 was read by Mr. Reichert.  The final reading will be read and voted on at the June meeting.
Mr. Reichert reported whether we need to establish a cable TV resolution as a result of new state cable regulation.  He said he researched the issue and spoke with the lawyers from Delhi and Symmes Townships.  They encouraged him to advise Council to pass a resolution as a preventative measure. 
He explained that the State of Ohio has now rights over all video service in the State concerning local government entities.  Our contract with Time Warner is in effect until November14, 2009.  Because of the State’s new legislation, once a new provider gives the State notice of intending to do business in North Bend, we will receive notice from the State.  Once we receive notice, we will have 10 days to tell them what our fees will be.  We need to have a resolution in place so we can get our current 5% fee off the monthly service subscriptions and also the new company’s advertising revenues.
Mr. Nunnery made the motion that the cable TV Resolution #2008-10  be passed.  Mr. Boll seconded the motion. Motion carried 100%.

COMMITTEES
Finance
Mr. Welch was excused so there was no financial report.

Light, Water and Sewer
Mr. Nunnery received a quote from Tri-State Liquid Waste in the amount of $2,145.00 to clean out the storm drain on the properties on Washington Avenue.  He explained the cost may vary because of the actual time needed for the job.  Mr. Nunnery made the motion to hire Tri State Liquid Waste provided the company does not appear on the State Auditor’s website under “Findings for Recovery” and provided the charges do not exceed $2,500.00.
Mr. Hartoin seconded the motion.  Motion carried 100%.
Mayor Simpson suggested that some regular preventative maintenance be completed on the line.  Mr. Hartoin suggested that the responsibility for maintaining the line be turned over to the Light, Water and Sewer Committee.  Council agreed.

Maintenance
Mr. Boll reported that the water leak in the road at Shady Lane and the entrance to Aston Oaks is thought to be the result of an underground spring.  JMA will look into whether the repair is the responsibility of the County or the Village.
JMA is also evaluating damage to St. Anne’s due to the dirt Mr. Niehaus moved off the top of the hill at St. Anne’s.  JMA reported that Mr. Niehaus had not obtained any cut and fill permit as required to move the dirt.  He also will be responsible for any of the road damage caused by the action.

Police & Fire
There was no report as Mr. Hartoin had reported on the Fire Station tour earlier.

Planning and Zoning
Due to the absence of Mr. Sammons, Mayor Simpson reported that the May Planning and zoning meeting had been cancelled.  It will be on Wednesday, June 18, 2008 at 7:00 P.M. in Council Chambers.

Law & Ordinance
Mrs. Romweber reported that there was no report and that the Council rules should be complete in a few days in time for the June meeting.

SOLICITOR NEW BUSINESS
Mr. Reichert read Ordinance #2008-04 Authorizing the Mayor to enter into agreement of cooperation with Hamilton County for fiscal years 2009, 2010, 2011 for the Community Development Block Grant Program.
Due to the time requirements, a motion to dispense with the three readings and declare an emergency made by Mr. Nunnery.  Motion seconded by  Mrs. Romweber.  Motion carried 100%.
A motion to accept Ordinance #2008-04 was made by Mr. Boll.  The motion seconded by Mr. Hartoin.  Motion passed 100%.

COUNCIL NEW BUSINESS
No Report

MAYOR’S NEW BUSINESS/REPORT
Mayor Simpson reported that POD volunteers are being requested to help should there be a pandemic outbreak in the Village area.
Interested volunteers especially with medical training are invited to a meeting June 19, 2008 at 6:30 P.M. in Miami Township Hall.
Mayor Simpson said the Memorial Day parade will assemble at 9:00A.M. at the High School.  The parade begins at 9:30 A.M. and will end at Harmony Field.  There will be a ceremony at Maple Grove Cemetery following the parade.

OPEN TO THE FLOOR
There was no business from the floor.

MAYOR & COUNCIL ANNOUNCEMENTS, COMMENTS
There is specific information regarding a golf outing on our website to benefit the families of Colerain Firefighters Robin Broxterman and Brian Schira who were killed in the Colerain house fire.

Mr. Nunnery made motion to adjourn the meeting at 8:00 P.M.  Mr. Hartoin seconded the motion.  Motion carried 100%.
