Meeting was called to order at 6:00 p.m. by Mayor Sammons.

MAYOR’S OPENING STATEMENT

Mayor Sammons reported that he attended a luncheon with the Colonial Dames in Dublin, Ohio on August 16, 2025. He gave a presentation on the WHH Riverfront Park and distributed the Brownstone Plan of the park to approximately 40 women. He advised them that the Village of North Bend is now a 501(c)(3) and any donations to our park could be tax deductible.

Joe Bonner moved that the July 28, 2025 minutes be accepted. Bill Deters seconded the motion. Motion carried 100%. (6-0)

TREASURER’S REPORT

In Marta’s absence, Dave Moorman read the Treasurer’s Report. The 2023-2024 routine audit is in progress.

Dave Moorman made a motion to declare Resolution 2025-24 an emergency and to dispense with the requirement that this resolution be read on three separate days and be adopted upon its first reading. Bill Deters seconded the motion. Motion carried 100%. (6-0)

Dave Moorman made a motion to adopt Resolution 2025-24 Amending the 2025 Tax Budget and Appropriations. Bill Deters seconded the motion. Motion carried 100%. (6-0)

The Treasurer’s Report is available at the Village office.

PAY THE BILLS

Fran Romweber made a motion to pay the bills. Bev Bolser seconded the motion. Motion carried 100%. (6-0)

MAINTENANCE SUPERVISOR’S REPORT

Nate reported that he installed a drain under the barn door to eliminate the door freezing in the closed position in the winter months. All fire hydrants in North Bend have been painted. Julius Howe Company will begin road repairs on Turnberry this Wednesday, August 27. Joe Bonner asked Marilyn to contact Three Rivers School to advise them of this road closure to reroute the bus service. Nate stated the sinkhole repair on US 50 at Shady Lane is a temporary repair at the cost of $16,000. The permanent repair was quoted at $130,000. Mayor Sammons stated he and Joe are in contact with Representative Odioso to help in passing legislation requiring ODOT be responsible for any repairs/replacement to a federal highway.

DEPUTY CLERK’S REPORT

Marilyn stated the biennial village audit, conducted by the State Auditor’s Office, is currently in progress. We passed our inspection with Miami Township Fire Department including the office buildings and the maintenance buildings. FES also came out and retagged all of our fire extinguishers. Marilyn took the Public Records training and listed herself as the designee for all elected officials. Our Records Retention meeting was earlier today and Marilyn will continue to peruse files to destroy. Our Residential Rental permit letters have been mailed to an updated list of owners. Miami Township Fire Department will train North Bend staff on our new AED on Friday, August 29th at 9:30am.

We will apply for an America 250 grant through the Heritage Foundation to support our projects. Miami Township’s Health and Wellness Fair is on September 9th and their Touch-A-Truck event is on October 11th . All North Bend residents are welcome. Marilyn met with Kerri Robers, MT Event Coordinator, and she offered North Bend a section in their newsletter. We can list our events, give updates on the WHH Park and promote North Bend in general. Our We Thrive meeting is September 3rd at 10:00am and our We Thrive meeting with Miami Township is September 17th at 1:00pm.

POLICE REPORT

Lt. Dan McElroy is North Bend’s new liaison with the Hamilton County Sheriff’s Office. He has been commander for two years and will be located at the Addyston office. The City of Harrison is building a new sub-station in the Community Center and Whitewater is now the only westside community that has not signed a contract with HCSO.

Lt. McElroy reported there were four criminal reports for the month of July. There were two thefts, one auto theft, and one burglary. There were five cases assigned to detectives for investigation.

FIRE REPORT

Bill Deters read the Miami Township Fire Department’s report. There were 15 EMS details and no fire runs for the month of July; two good intent calls and one fire alarm. There were two fire inspections, four fire hydrants were flushed and one public relations event.

THREE RIVERS SCHOOL

Superintendent Tim Sies introduced himself to council; he’s been in education for twenty-five years, seventeen years at North College Hill. Mr. Sies stated Three Rivers School is celebrating their 100th year. They have yard signs to distribute. Twenty-eight students received a perfect score on the Ohio State test.

THREE RIVERS SCHOOL, Continued

Three awards were given to dancers in the drama department. As of January 1, 2026 a new cell phone policy was going into effect and Mr. Sies implemented it with the new school year beginning August, 2025. There’s no cell phone use permitted from “Bell to Bell”. TRS has 352 student athletes participating in all sports. TRS will host a Band Invitational on September 20, 2025. Mayor Sammons and Fran Romweber both were substitute teachers at TRS.

COMMITTEES:

Finance - Mr. Moorman

There was a discussion of the Emergency Operations Plan that was presented to council at our July 28th council meeting. Bev Bolser had several change requests. Dave will speak with Mr. Wesley Gutridge, Hamilton County, and adjust the plan accordingly.

Mayor Sammons stated he’d like to have Hamilton County provide a walkie talkie to communicate with them if an emergency arises.

Light, Water and Sewer - Mrs. Romweber

Joe mentioned he is checking into the Metropolitan Planning Organization, which is a regional transportation planning body, responsible for managing the planning process; regarding the responsibility of US 50 repairs.

Police & Fire – Mr. Deters

Planning & Zoning - Mrs. Bolser

Mayor Sammons stated John Niehaus is drilling 19 new bore holes on the St. Annes property known as Glen Eagles Subdivision. He may be initiating a new plan with 48 condominiums.

Law & Ordinance - Mr. Weadick

Mark stated he met with Mr. Roberson, Nate, and Rick regarding Mr. Roberson’s sidewalk issue. It appears that Mr. Roberson has resolved the issue of constant water and mud settling on the sidewalk, as it has remained dry.

Mark stated Scott sent a violation letter to the owner of the property on Harrison Avenue regarding a trucking business operating on that property. No response as of yet.

Beautification – Mrs. Romweber

Fran thanked Nate and the maintenance staff for nurturing the beautiful flowers. Mayor Sammons asked Nate to apply a deer repellent to the flower boxes.

COUNCIL’S OLD BUSINESS

There was a discussion on allowing marijuana dispensaries in the Village of North Bend. Mayor Sammons stated it would have a positive economic impact for the village as 3.6% of the 10% excess tax would come to the village. Dave Moorman reminded Council that the 64% of North Bend’s voters, voted AGAINST legalizing recreational marijuana, Ohio Issue 2 in November-2023.

COUNCIL’S OLD BUSINESS, Continued

Scott presented the Marijuana Dispensary Zoning Regulations to council and stated he has prepared a resolution imposing a moratorium on marijuana and recommends we pass that resolution.

However, council should review those zoning regulations and if council decides to allow marijuana dispensaries within the Village of North Bend, the resolution can be rescinded. Mayor Sammons also stated these additional monies could reduce taxes for residents.

Dave Moorman made a motion to declare Resolution 2025-25 an emergency and to dispense with the requirement that this resolution be read on three separate days and be adopted upon its first reading. Bill Deters seconded the motion. Motion carried 100%. (6-0)

Dave Moorman made a motion to adopt Resolution 2025-25 Resolution Imposing an Eighth Extension of an Additional One-Year Moratorium on the Issuance and Processing of Any Permits Allowing Retail Dispensaries, Cultivators, or Processors of Medical or Recreational Marijuana within the Village of North Bend, Ohio. Bill Deters seconded the motion. Motion carried 100%. (6-0)

COUNCIL’S NEW BUSINESS

Council discussed the topic of depositing any permit fees the Village receives into the CIC account with the intent of it being utilized for the construction and/or maintenance of the WHH Riverfront Park. After consideration, council decided to continue to deposit those funds into the general fund.

Dave Moorman said he registered for the webinar regarding information on Cyber Security Training. This webinar is hosted by The Ohio Municipal League. The law will be active January 1, 2026 and verification will be implemented July, 2026. Bev Bolser stated she tried to register and was denied as the webinar was full. Mayor Sammons asked Marilyn to check with our insurance agent to verify coverage for cyber security related claims.

LAW DIRECTOR’S NEW BUSINESS

Fran Romweber made a motion to provide the Law Solicitor authority to approve, on behalf of the Village of North Bend, Hamilton County, Ohio, the currently proposed Chapter 11 bankruptcy plan for the Purdue Pharma case. Mark Weadick seconded the motion. Motion carried 100%. (6-0)

Dave Moorman made a motion to declare Resolution 2025-26 an emergency and to dispense with the requirement that this resolution be read on three separate days and be adopted upon its first reading. Bill Deters seconded the motion. Motion carried 100%. (6-0)

Dave Moorman made a motion to adopt Resolution 2025-26 an Emergency Resolution Providing Authority to the Law Solicitor to Execute the Subdivision and Special District Settlement Participation Forms for the Secondary Manufacturers’ Settlements Participation Form Agreement. Bill Deters seconded the motion. Motion carried 100%. (6-0)
